Every state regulates and licenses real estate agents and the real estate brokers they work for. Real estate brokers and agents must meet state-mandated levels of education, training and testing.

— A listing or seller's agent represents the seller. This real estate agent is hired to market and sell the home. Seller's agents market the property through for sale signs, newspaper ads, the MLS (Multiple Listing Service) and other networks. They typically provide the seller with up-to-date information on the current market conditions. Many times the seller's agent will recommend repairs and cosmetic work to help the seller get the highest price possible.
— New homes sales agents work for a builder or developer of a new home subdivision, a condominium development or a planned community. Their main interest is in selling one of the builder's units or homes at the best possible price. Buyers interested in a new home or condo
will often bring their own buyer's agent to help them get the most incentives, the best upgrades and amenities and the best possible price.
— Exclusive buyer agents are associated with brokers who work only for buyers of homes. Their mission is to help the buyer find the house or condo that is right for them, at the best possible price and terms. The service of an exclusive buyer agent is free to the buyer because the seller pays commission to the agents. If there is no buyer agent in a transaction, the seller's agent takes the entire commission, otherwise it is split between the agents.
The dual agent works for both the seller and the buyer. This arrangement may make it difficult for the agent to represent both parties' interests equally; it often works the best interest of the buyer.
